The Court of Justice confirms that "economic successors" of businesses that have infringed Article 101 may also be held liable for damages claims. Under the economic continuity doctrine, competition agencies have been able to use an exception to the principle of personal liability to fine economic successors of business involved in cartels. The judgment confirms that this applies also to private damages.
