Consent by scrolling or swiping? The EDPB says no.

In its latest guidance on consent under the GDPR, the EDPB took a strong position on the validity of the (in)famous sentence found on many websites, stating that "by continuing to surf on our website you agree to our processing of your personal data" or a variation thereof. 

While this position will be no surprise for most data protection experts, now may be a good time to check for the absence of this type of language in your own website privacy or cookie policy. 

actions such as scrolling or swiping through a webpage or similar user activity will not under any circumstances satisfy the requirement of a clear and affirmative action
